By making a booking session with Nick’s Method, our client must agree with the below:
Participant Agreement, Release, and Assumption of Risk
By making a booking with Nick’s Method, I acknowledge that I have read, understood, and agreed to the following terms and conditions related to participation in tutoring and academic coaching provided by Nick’s Method. Booking a session, whether online or in person, automatically signifies agreement to this waiver. 1. Acknowledgment of Risk
I understand that participating in tutoring or academic coaching at Nick’s Method involves inherent risks. These risks may include, but are not limited to, mental fatigue, eye strain from screen time, and potential unforeseen complications related to learning activities. While Nick’s Method and its instructors take all reasonable precautions to provide a safe learning environment, I acknowledge that unforeseen incidents may still occur.
Additionally, I acknowledge that the learning environment at Nick’s Method is not an allergy-free space. There may be exposure to allergens such as nuts, pets, or other potential triggers. Nick’s Method is not responsible for allergic reactions or sensitivities that may arise during in-person sessions.
2. Assumption of Responsibility
I voluntarily assume full responsibility for any risks, challenges, or academic outcomes that may arise from my participation in activities at Nick’s Method. I acknowledge that it is my responsibility to ensure that I am prepared for tutoring sessions and that I take an active role in my own learning process.
I also understand that Nick’s Method is not responsible for any lost, stolen, or damaged personal belongings during in-person sessions. I agree to take necessary precautions to secure my personal items.
3. Release of Liability
I, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, hereby release, indemnify, and hold harmless Nick’s Method, its owners, employees, instructors, contractors, affiliates, and agents from any claims, demands, actions, or liabilities related to any academic challenges, learning difficulties, allergic reactions, lost or stolen personal items, or outcomes that I may experience while participating in tutoring sessions, whether caused by negligence or otherwise, to the fullest extent permitted by law.
4. Technology & Online Learning Risks
For online tutoring and coaching sessions, I understand that technical issues may arise, including but not limited to connectivity problems, software malfunctions, or disruptions. Nick’s Method is not responsible for any technical difficulties that may interfere with the learning experience. I also acknowledge that I am responsible for maintaining a suitable learning environment, including appropriate internet access and device functionality.
5. Compliance with Rules and Instructions
I agree to comply with all academic policies, guidelines, and instructions provided by Nick’s Method staff. I understand that failure to adhere to these guidelines may result in dismissal from tutoring services without a refund.
6. Media Release
I grant permission to Nick’s Method to capture photos, videos, or other media of me during participation in tutoring sessions for promotional and educational purposes. I understand that my likeness may be used in marketing materials, social media, and other platforms unless I explicitly opt out in writing.
7. Acknowledgment of Understanding
I have read this Liability Waiver thoroughly and fully understand its terms. By proceeding with a booking, I acknowledge that I am waiving certain legal rights, including the right to sue. Booking a session with Nick’s Method, whether online or in person, automatically signifies my agreement to this waiver.
If the participant is under 18 years old, a parent or guardian must complete the booking on their behalf, and by doing so, agrees to this waiver on their behalf.
